A pension plan paid a single life annuity benefit to a participant. Following the participant’s death, the Plan mistakenly continued paying those benefits to his widow for four years resulting in a $80,000 overpayment.
The plan reclaimed $24,000 through direct deposit reversals and then sought recovery of the remaining $56,000.00 overpayment from the 93-year-old widow.
The Upper Midwest Pension Project negotiated with the plan, and it subsequently agreed to cancel the outstanding overpayment and resume monthly payments to the widow at the 50% survivor benefit rate for her lifetime.
