A client had been receiving his pension benefit for over 25 years. In November 2024 the client’s monthly pension benefit was suspended without notice. When he called the plan to inquire about his pension benefit, he was told that he owed the plan $320,000 as an overpayment. 

The plan would not provide the client with any information regarding his case until our office was involved. The Mid America Pension Project immediately made a written request for documents. The plan’s attorney provided an old document where the client’s name appeared on a list. Upon review of the document, our attorney immediately noted that the client’s name was on the list, but the document clearly stated that he was entitled to a pension benefit from the plan.

Our attorney provided the plan’s attorney with our client’s supporting evidence and pointed out that the document that the plan relied on clearly showed that our client was entitled to his benefit. 

Upon reviewing the information, the plan’s attorney agreed with the Mid America Pension Project attorney. Our client’s pension was immediately reinstated, he received a retroactive payment of approximately $5,000, and the $320,000 overpayment was waived. 

Our client and his wife were in the process of moving to assisted living and relied on his benefit to pay for basic necessities. Not only did our office assist our client by reinstating his pension, but we also gave him peace of mind.
